"Hot Button" Zoning Issues

Chickens on Residential Properties

Township Council is currently considering amending Hampton’s Zoning Ordinance to expand the allowance for chickens on residential properties. Under Hampton’s current Zoning Ordinance, chickens ARE allowed to be kept on residential properties as an accessory use without a permit, provided the following criteria is met (link to ordinance section: ):

  • Only allowed in the Conservation B (CB) zoning district
  • A minimum lot size of 5 acres is required
  • The use is only allowed for the personal, non-commercial use of the property
  • Any chicken coop must be at least 100’ from any property line or street boundary
  • The chickens must be kept entirely within a fence, which must be set back at least 25’ from any property line or street boundary
  • No more than 10 chickens per acre of fenced in area are permitted

As a part of the research for this topic, a survey of twelve surrounding municipalities was conducted, to compare the regulations for chickens on residential properties in the neighboring communities.  For any residents who are interested in this topic, the results of this survey are linked below:

Upcoming Meeting Schedule:

June 24, 2020 - Council Meeting (7:30 pm in the Hampton Community Center): The Land Use Administrator will request for authorization from Council to start the process of updating Township’s Zoning Ordinance to incorporate several previously approved zoning-related ordinances, as well as to revise the allowance for chickens on residential properties.  This is just a vote for Council to authorize Township staff to start the process of drafting the ordinance.  Council will NOT be voting on the final issue of whether or not to expand the chicken allowance, or what those regulations might say. 

Land Development Applications

20-01 Eat’n Park Revised Site Plan/Conditional Use/Lot Line Revision

The applicant is proposing to redevelop the site of the existing Eat ‘N Park restaurant, located at 5143 Route 8 in an HC zoning district. The project would revise the location of the shared lot lines with the property to the northwest, also zoned HC, and would cover numerous site improvements, including the construction of a new restaurant building to replace the existing Eat ‘N Park, a revised parking layout, the installation of a drive-thru lane for take-out orders, and other required site improvements.

This application will be reviewed by the EAC on June 1, 2020 at 7:00 pm and by the Planning Commission on October 12, 2020 at 7:30 pm.  A Public Hearing will be held in regard to the Conditional Use application on June 10, 2020 at 7:30 pm prior to the regularly scheduled Council meeting.  The application will be reviewed by Township Council on January 13, 2021 and January 27, 2021 at 7:30 pm.

20-08 Hampton Industrial Park Revised Site Plan

The applicant is proposing to construct a new 28,000 square foot commercial warehouse building within the existing Hampton Industrial Park on Alpha Drive in a Light Industrial (LI) zoning district.  The project will include the installation of the required stormwater management facility, parking area, and landscaping.

This application will be reviewed by the EAC on December 7, 2020 at 7:00 pm, and by the Planning Commission on January 11, 2021 at 7:30 pm.  The application will be reviewed by Township Council on January 13, 2021 and January 27, 2021 at 7:30 pm.

20-09 3141 Harts Run Road Interior Only Conditional Use

The applicant, Elizabeth Werling, is requesting conditional use approval to open a wine tasting room in the lower suite of the previously approved two-unit commercial building at 3141 Harts Run Road, in a Neighborhood Commercial (NC) zoning district.  The Zoning Ordinance lists “alcohol sales” as condition use in the NC district.  No exterior site or building changes are proposed.  

This application will be reviewed by the Planning Commission on November 9, 2020 at 7:30 pm.  A Public Hearing will be held on December 9, 2020 at 7:30 pm prior to the regularly scheduled Council meeting.  The application will be reviewed by Township Council on January 13, 2021 and January 27, 2021 at 7:30 pm.

Variance Applications

THE ZONING HEARING BOARD WILL CONDUCT A PUBLIC HEARING ON TUESDAY, JANUARY 26, 2021 AT 7:30 PM TO HEAR THE FOLLOWING CASES:

CASE NO. 21-01 – The applicants, Jody & Jennifer Neiswonger, are requesting a variance to the Zoning Ordinance, No. 310, SECTION 310-72, SUBSECTION D, for a proposed front yard fence to be located at 4900 Ottawa Court that exceeds the 4’ height limit by approximately 2’ and is proposed to connect the fences on the adjacent properties in a Residential B (RB) zoning district.  

 

CASE NO. 21-02 – The applicants, Ronald & Grace Deems of 5142 Gibson Road, are requesting a variance to the Zoning Ordinance, No. 310, under SECTION 310-119, SUBSECTION A, PARAGRAPHS 1 & 4, and SUBSECTION B, PARAGRAPH 1, to continue operating their plumbing business Deems Plumbing on property located at 5146 Gibson Road in a Residential B (RB) zoning district.

 

CASE NO. 21-03 – The applicants, Michael & Ashley McAneny, are requesting a variance to the Zoning Ordinance, No. 310, TABLE A, for a proposed lot line revision on the lots located at 2402, 2408, and 2414 Thomas Drive (Parcel Nos. 948-R-150, 948-R-152, and 948-R-154) that would reduce the front yard setback to 15’, which encroaches on the previously recorded setback of 25’ from Thomas Drive in a Residential A (RA) zoning district.
