Chickens on Residential Properties

Township Council is currently considering amending Hampton’s Zoning Ordinance to expand the allowance for chickens on residential properties. Under Hampton’s current Zoning Ordinance, chickens ARE allowed to be kept on residential properties as an accessory use without a permit, provided the following criteria is met (link to ordinance section: ):

  • Only allowed in the Conservation B (CB) zoning district
  • A minimum lot size of 5 acres is required
  • The use is only allowed for the personal, non-commercial use of the property
  • Any chicken coop must be at least 100’ from any property line or street boundary
  • The chickens must be kept entirely within a fence, which must be set back at least 25’ from any property line or street boundary
  • No more than 10 chickens per acre of fenced in area are permitted

As a part of the research for this topic, a survey of twelve surrounding municipalities was conducted, to compare the regulations for chickens on residential properties in the neighboring communities.  For any residents who are interested in this topic, the results of this survey are linked below:

Upcoming Meeting Schedule:

April 12, 2021 - Planning Commission Meeting (7:30 pm in the Hampton Community Center): The second draft of the proposed new chicken regulations will be reviewed by the Township Planning Commission and Land Use Administrator.  This meeting is open to the public and all are welcome to attend. This is the second review meeting for this update, and no final action or vote will be made.

Land Development Applications



The following is a list of Land Development applications that are currently under review with the Township.  Individual building permits, or building permit applications have not been included on the list.  To request information regarding any of the following applications, please contact the Land Development Office at (412) 486-0400 ext. 1327.  Please see below for a list of variance applications currently under review.

20-01 Eat’n Park Revised Site Plan/Conditional Use/Lot Line Revision

The applicant is proposing to redevelop the site of the existing Eat ‘N Park restaurant, located at 5143 Route 8 in an HC zoning district.  The project would cover numerous site improvements, including the full renovation the existing restaurant building, a revised parking layout, the installation of a drive-thru lane for take-out orders, and other required site improvements.

This application will be reviewed by the EAC on April 5, 2021 at 7:00 pm and by the Planning Commission on April 12, 2021 at 7:30 pm.  A Public Hearing was held in regard to the Conditional Use application on June 10, 2020 at 7:30 pm prior to the regularly scheduled Council meeting.  The application will be reviewed by Township Council on April 14, 2021 and April 28, 2021 at 7:30 pm.

21-01 Country Lane Simple Subdivision

The applicant is proposing to build a second story addition on the existing rear classroom building, located at 2308 W. Hardies Road in an RB zoning district, by approximately 1,100 square feet.  This expansion will relocate existing students and provide accommodations for new students.  This addition will double the size of the rear school building and add a walking connection to the front classroom building.  Additions to non-residential structures that exceed 1,000 square feet in size require the approval of a Revised Site Plan application. 

This application will be reviewed by the Planning Commission on March 8, 2021 at 7:30 pm and by Township Council on April 14, 2021 and April 28, 2021 at 7:30 pm.

21-02 Aquinas Academy Classroom Addition Revised Site Plan

The applicant is proposing to build a second story addition on the existing rear classroom building, located at 2308 W. 21-03 Laurel Lane Simple Subdivision

The applicant is proposing to subdivide an existing 15-acre lot (Parcel No. 829-J-101) located on the private road Laurel Lane in a Residential A (RA) / Residential B (RB) zoning district.  The proposed plan would create one new buildable lot on the existing private road.  A modification to the SALDO is also being requested since the property is over 10 acres in size.  

This application will be reviewed by the Planning Commission on April 12, 2021 at 7:30 pm, and by Township Council on May 12, 2021 and May 26, 2021 at 7:30 pm.

21-04 Hampton High School Revised Site Plan

The applicant, Hampton Township School District, is proposing a major redesign of the Hampton High School property located at 2929 McCully Road in a Conservation A (CA) zoning district.  The plan includes revisions to the site’s traffic design and parking areas, as well as the addition of a second entrance/exit to Topnick Drive.  The proposal also includes two additions to the building, as well as the required associated stormwater management, lighting, and landscaping improvements.  Variances have been filed to the ZHB related to the building signage and to the UCC Appeals Board related to the storm shelter requirements for the additions.

The application will be reviewed by the Environmental Advisory Council on April 5, 2021 at 7:00 pm and by the Planning Commission on April 12, 2021 at 7:30 pm.  The application will be reviewed by Township Council on May 12, 2021 and May 26, 2021 at 7:30 pm.

21-05 Hampton High School Conditional Use

The applicant, Hampton Township School District, is requesting to construct a 2,400 square foot storage garage on the Hampton High School property, located at 2929 McCully Road in a Conservation A (CA) zoning district.  The garage will be used to store property maintenance and lawn care equipment.  In the CA zoning district, accessory structures that are used for the maintenance of recreational facilities require conditional use approval by Township Council.  

This application will be reviewed by the Planning Commission on April 12, 2021 at 7:30 pm.  A Public Hearing will be held on May 12, 2021 at 7:30 pm prior to the regularly scheduled Council meeting  The application will be reviewed by Township Council on May 12, 2021 and May 26, 2021 at 7:30 pm.

21-06 4640 Route 8 ATM Site Plan

The applicant, James Blakley, is proposing to construct a drive-up ATM on the vacant lot located at 4640 Route 8, in a Highway Commercial (HC) zoning district.  This project would include the construction of a new drive-up ATM and loop road that would access onto Talley Cavey Road, along with the associated SWM, lighting, and landscaping required.

This application will be reviewed by the Environmental Advisory Council on April 5, 2021 at 7:00 pm and by the Planning Commission on April 12, 2021 at 7:30pm.  This application will be reviewed by Township Council on May 12, 2021 and May 26, 2021 at 7:30 pm.

21-07 4640 Route 8 ATM Conditional Use

The applicant, James Blakley, is proposing to construct a drive-up ATM on the vacant lot located at 4640 Route 8, in a Highway Commercial (HC) zoning district.  The Zoning Ordinance specifies that drive-in banking facilities are a Conditional Use in the HC zoning district.  An associated Site Plan application has been submitted for the improvements.

This application will be reviewed by the Planning Commission on April 12, 2021 at 7:30 pm.  A Public Hearing will be held on May 12, 2021 at 7:30 pm prior to the regularly scheduled Council meeting  The application will be reviewed by Township Council on May 12, 2021 and May 26, 2021 at 7:30 pm.

21-08 Century Interiors Change of Use

In accordance with Section 310-63 C. of the Zoning Ordinance, the applicant, Century Interiors Inc., is requesting a Change of Use approval for the property located at 2772 Harts Run Road in a Highway Commercial (HC) zoning district.  This property formerly housed Revelation Health, a retail health products store but has been vacant for over a year.  The applicant is requesting to change the approved use from retail to office space so that the building can be used as the main office for Century Interiors Inc., a painting and construction company.

This application will be reviewed by Township Council on April 14, 2021 and April 28, 2021 at 7:30 pm.

Variance Applications

THE ZONING HEARING BOARD WILL CONDUCT A PUBLIC HEARING ON TUESDAY, FEBRUARY 23, 2021 AT 7:30 PM TO HEAR THE FOLLOWING CASES:

  

CASE NO. 21-04The applicant, Eat 'N Park Inc., is requesting a variance to the Zoning Ordinance, No. 310, under the following sections; ARTICLE X, SECTION 310-59, TABLE E, and 310-59 E. [3] (d), related to encroachments in the required buffer yards on all sides and for the required landscaping to be located off-site, on the adjacent property; SECTION 310-65 C. for the number of replacement trees; SECTIONS 310-65 H. (1) and (2) for the parking lot landscaping; and SECTION 310-65, PARAGRAPH E., and SUBSECTIONS (1) and (2) of the same, for the required tree spacing and the number of trees.  They are also requesting a variance to ARTICLE XIII, SECTION 310-79, A., for the dimensions of the parking spaces.  These variances are for the property located at 5143 Route 8, in a Highway Commercial (HC) zoning district, which is the site of an existing Eat 'N Park restaurant that the company would like to redevelop and improve.  

 

CASE NO. 21-05 – The applicant, Accel Sign Group Inc. on behalf of Eat’n Park, is requesting a variance to the Zoning Ordinance, No. 310, under ARTICLE 310-87, SECTION B, SUBSECTION 1, for a dynamic display sign that is proposed to be more than 25% of the actual copy and graphic area of the freestanding sign, on property located at 5143 Route 8.
