"Hot Button" Zoning Issues

Chickens on Residential Properties

Township Council is currently considering amending Hampton’s Zoning Ordinance to expand the allowance for chickens on residential properties. Under Hampton’s current Zoning Ordinance, chickens ARE allowed to be kept on residential properties as an accessory use without a permit, provided the following criteria is met (link to ordinance section: ):

  • Only allowed in the Conservation B (CB) zoning district
  • A minimum lot size of 5 acres is required
  • The use is only allowed for the personal, non-commercial use of the property
  • Any chicken coop must be at least 100’ from any property line or street boundary
  • The chickens must be kept entirely within a fence, which must be set back at least 25’ from any property line or street boundary
  • No more than 10 chickens per acre of fenced in area are permitted

As a part of the research for this topic, a survey of twelve surrounding municipalities was conducted, to compare the regulations for chickens on residential properties in the neighboring communities.  For any residents who are interested in this topic, the results of this survey are linked below:

Upcoming Meeting Schedule:

April 12, 2021 - Planning Commission Meeting (7:30 pm in the Hampton Community Center): The second draft of the proposed new chicken regulations will be reviewed by the Township Planning Commission and Land Use Administrator.  This meeting is open to the public and all are welcome to attend. This is the second review meeting for this update, and no final action or vote will be made.

The following is a list of Land Development applications that are currently under review with the Township.  Individual building permits, or building permit applications have not been included on the list.  To request information regarding any of the following applications, please contact the Land Development Office at (412) 486-0400 ext. 1327.  Please see below for a list of variance applications currently under review.

21-09 Modwash Site Plan

The applicant is proposing to construct an automatic carwash with associated parking, stormwater management, and utilities, on vacant property located at 5315 Route 8 in a Highway Commercial (HC) zoning district.  This is Lot 1 of the previously approved 5315 Route 8 Subdivision plan.

This application will be reviewed by the Environmental Advisory Council on August 2, 2021 at 7:00 pm and by the Planning Commission on August 9, 2021 at 7:30pm.  This application will be reviewed by Township Council on August 11, 2021 and August 25, 2021 at 7:30 pm.

21-10 A&D Holding Simple Subdivision

The applicant is proposing to subdivide an existing commercial lot located at 2661 Clearview Road in a Highway Commercial (HC) zoning district.  The proposed plan would create two separate lots for two commercial buildings that are currently both on the same lot.  Each lot will be over 1 acre in size and a right-of-way will be dedicated to allow access from the rear lot to Clearview Road.      

This application will be reviewed by the Planning Commission on June 14, 2021 at 7:30pm and by Township Council on July 14, 2021 and July 28, 2021 at 7:30 pm.

21-12 McGann/Andrews Drive Simple Subdivision

The applicant is proposing to subdivide an existing 8.5-acre residential lot located at 4839 Andrews Drive in a Residential A (RA) zoning district.  The proposed plan would create two separate parcels to allow the construction of a new buildable lot for a family member.  Each lot will be over one-acre in size.  A variance has been requested since each lot will have less than the required 150’ of frontage.

This application will be reviewed by the Planning Commission on July 12, 2021 at 7:30pm.  This application will be reviewed by Township Council on August 11, 2021 and August 25, 2021 at 7:30 pm.

21-13 4020 Grand Avenue Lot Consolidation

The applicant is seeking approval to consolidate several portions of the subject property that were previously separated by several paper streets adjoining their property located at 4020 Grand Avenue in the Residential C (RC) and Highway Commercial (HC) zoning districts.  

This application will be reviewed by the Planning Commission on August 9, 2021 at 7:30pm.  This application will be reviewed by Township Council on August 11, 2021 and August 25, 2021 at 7:30 pm.

21-14 Hampton Woodlands Subdivision/Lot Consolidation

The Hampton Woodlands Homeowners Association is seeking approval to reconfigure the location of several lot lines and open spaces parcels in the Hampton Woodlands development on Woodland Circle in a Residential B (RB) zoning district. The application would relocate open space that is controlled by the HOA to increase the buildable area for the remaining vacant lots in the development.

This application will be reviewed by the Planning Commission on July 12, 2021 at 7:30pm.  This application will be reviewed by Township Council on August 11, 2021 and August 25, 2021 at 7:30 pm.

21-15 St. Ursula Subdivision/Lot Consolidation

The applicant, the Diocese of Pittsburgh, is seeking approval to reconfigure the location of several lot lines between the existing St. Ursula Parish building and the former St. Ursula school building on Kirk Avenue in a Residential C (RC) zoning district. The proposal would create two separate lots for the parish and school buildings, with a shared access easement between them.

This application will be reviewed by the Planning Commission on July 12, 2021 at 7:30pm.  This application will be reviewed by Township Council on August 11, 2021 and August 25, 2021 at 7:30 pm.

Variance Applications

THE ZONING HEARING BOARD WILL CONDUCT A PUBLIC HEARING ON TUESDAY, JULY 27, 2021 AT 7:30 PM, AT THE COMMUNITY CENTER TO HEAR THE FOLLOWING CASE:

CASE NO. 21-17 – The applicant, Devon Schenker, is requesting a variance to the Zoning Ordinance, No. 310, under TABLE A,  for an existing shed that encroaches on the required 10’ side setback by approximately 6’, on property located at  4727 Hidden Pond Drive.

CASE NO. 21-18WITHDRAWN - The applicant, David Vickers, is requesting a variance to the Zoning Ordinance, No. 310, SECTION 310-75, SUBSECTION C, PARAGRAPH 8, for a proposed inground pool located in front of the leading edge of the primary structure on property located at 2441 Rihn Strasse.

CASE NO. 21-19 – The applicant, St. Ursula Parish, is requesting a variance to the Zoning Ordinance, No. 310, TABLE A, for a proposed subdivision that does not meet the 25’ side yard requirements for the RC zoning district, on property located at 3937 Kirk Avenue.
