"Hot Button" Zoning Issues

Chickens on Residential Properties

Township Council is currently considering amending Hampton’s Zoning Ordinance to expand the allowance for chickens on residential properties. Under Hampton’s current Zoning Ordinance, chickens ARE allowed to be kept on residential properties as an accessory use without a permit, provided the following criteria is met (link to ordinance section: ):

  • Only allowed in the Conservation B (CB) zoning district
  • A minimum lot size of 5 acres is required
  • The use is only allowed for the personal, non-commercial use of the property
  • Any chicken coop must be at least 100’ from any property line or street boundary
  • The chickens must be kept entirely within a fence, which must be set back at least 25’ from any property line or street boundary
  • No more than 10 chickens per acre of fenced in area are permitted

As a part of the research for this topic, a survey of twelve surrounding municipalities was conducted, to compare the regulations for chickens on residential properties in the neighboring communities.  For any residents who are interested in this topic, the results of this survey are linked below:

Upcoming Meeting Schedule:

June 24, 2020 - Council Meeting (7:30 pm in the Hampton Community Center): The Land Use Administrator will request for authorization from Council to start the process of updating Township’s Zoning Ordinance to incorporate several previously approved zoning-related ordinances, as well as to revise the allowance for chickens on residential properties.  This is just a vote for Council to authorize Township staff to start the process of drafting the ordinance.  Council will NOT be voting on the final issue of whether or not to expand the chicken allowance, or what those regulations might say. 

Land Development Applications

20-01 Eat’n Park Revised Site Plan/Conditional Use/Lot Line Revision

The applicant is proposing to redevelop the site of the existing Eat ‘N Park restaurant, located at 5143 Route 8 in an HC zoning district. The project would revise the location of the shared lot lines with the property to the northwest, also zoned HC, and would cover numerous site improvements, including the construction of a new restaurant building to replace the existing Eat ‘N Park, a revised parking layout, the installation of a drive-thru lane for take-out orders, and other required site improvements.

This application will be reviewed by the EAC on June 1, 2020 at 7:00 pm and by the Planning Commission on July 13, 2020 at 7:30 pm.  A Public Hearing will be held in regard to the Conditional Use application on June 10, 2020 at 7:30 pm prior to the regularly scheduled Council meeting.  The application will be reviewed by Township Council on July 8, 2020 and July 22, 2020 at 7:30 pm.

20-02 North Park Sports Complex Conditional Use

The applicant, PCG Acquisitions LLC, is requesting to add a second approved use for “convention/rental space” to the previously approved “commercial recreation” use at the North Park Sports Complex, located at 2330 Wildwood Road in a Light Industrial (LI) zoning district, in order to hold periodic home/trade shows in a portion of the existing dome structure.  

Groups of two or more businesses on one site with shared parking may only be permitted if granted as a conditional use by Township Council.  Additionally, although “convention/rental space” is not specifically listed as an allowable use in the LI zoning district, it may be granted as a conditional use if Council finds it to be similar to and compatible with adjacent (or surrounding) existing and permitted uses.  

This application will be reviewed by the Planning Commission on June 8, 2020 at 7:30 pm.  A Public Hearing will be held on June 10, 2020 at 7:30 pm prior to the regularly scheduled Council meeting.  The application will be reviewed by Township Council on July 8, 2020 and July 22, 2020 at 7:30 pm.

20-04 Klaas Home Daycare Conditional Use

The applicant, Beth Klaas, is requesting conditional use approval to expand her existing home-based daycare, located at 3925 Mt. Royal Blvd., in a Residential B (RB) zoning district.  The property owner was granted approval in 1997 for a home-based daycare for up to 6 children.  Approval of this conditional use application would allow the applicant to care for up to 12 children under the age of 16 at one time in her home-based daycare, which is allowable only as a conditional use in the RA and RB zoning districts.  

This application will be reviewed by the Planning Commission on July 13, 2020 at 7:30 pm.  A Public Hearing will be held on August 12, 2020 at 7:30 pm prior to the regularly scheduled Council meeting.  The application will be reviewed by Township Council on August 12, 2020 and August 26, 2020 at 7:30 pm.

Variance Applications

COVID-19 UPDATE:  Hampton Township Zoning Hearing Board will hold its monthly June and July meetings at the Community Center.  This measure is being taken to allow for proper social distancing measures to prevent the spread of COVID-19.  

THE ZONING HEARING BOARD WILL CONDUCT A PUBLIC HEARING ON TUESDAY, JULY 28, 2020 AT 7:30 PM TO HEAR THE FOLLOWING CASES:

CASE NO. 20-12 – The applicant, Thomas M. Vey, is requesting a variance to the Zoning Ordinance, No. 310, under TABLE A, for an existing enclosed porch that encroaches on the required 30’ side yard setback by approximately 22’, on property located at 2936 Clearview Road.


CASE NO. 20-13 – The applicant, Amber Bill, is requesting a variance to the Zoning Ordinance, No. 310, under TABLE A, for a proposed in-ground pool that encroaches on the required 30’ setback from a right-of-way by approximately 20’, as well as a variance for a proposed fence that encroaches on the required 8’ setback from a right-of-way by approximately 3’, on property located at 4020 Grand Avenue.
